PA 5: Fair Remuneration

Question: 5.4 Is there satisfactory evidence that the auditee provides sufficient remuneration that allows workers to meet a decent standard of living?

Finding
Amfori BSCI Code of Conduct requirement on Fair Remuneration: Business partners observe this principle when they respect the right of the workers to receive fair remuneration that is sufficient to provide them with a decent living for themselves and their families, as well as the social benefits legally granted, without prejudice to the specific expectations set out hereunder.
FINDING: During review of wage & benefit policy,dialogue with interviewed workers and HR personnel, it was noted that the salary for the employees was satisfied the basic need wage of the region. However, there was no evidence to prove that the facility conducted the survey the employees about the basic need wage that allow them to have a decent standard of living in the region.

PA 6: Decent Working Hours

Question: 6.2 CRUCIAL: Is there satisfactory evidence that the auditee request of overtime is in line with the requirements of the amfori BSCI Code of Conduct?

Finding
Local law: Vietnam Labor Code, No. 45/2019/QH14, Article 107. Overtime work, 2. An employer
has the right to request an employee to workovertime when all of the following conditions are met:
a) The employee agrees to work overtime;
b)The number of overtimes working hours of the employee does not exceed 50% of the normal working hours in 01 day; in case of weekly work,the total normal working hours plus overtime working hours shall not exceed 12 hours in 01 day,and 40 hours in 01 month.
FINDING: Monthly excessive 40 overtime hours were detected for sampled workers in cleaning,punching, manual folding section during dialogue with workers & HR personnel and review of sampled time records & payrolls. Details as following:
+ 1 out of 20 sampled workers have worked overtime 42.5 hours in June 2023.
+ 2 out of 20 sampled workers have worked overtime 40.5 hours in April 2023.
PA 7: Occupational Health and Safety

Question: 7.7 Is there satisfactory evidence that the auditee implements engineering and administrative control measures to avoid or minimise the release of hazardous substances into the work environment,keeping the level of exposure below internationally established or recognised limits?

Local Law: Article 27 of Law on chemical No. 06/2007/QH12 dated 21st November 2007 of the XII
National Assembly: Chemicals must be classified and labelled prior to transportation and using. The label shall be in Vietnamese.
FINDING: During the facility tour and management interview, it was noted that 04 out of 10 observed chemical drums at printing area were not labelled.As facility observation and management interview,these drums are solvent.

Question: 7.9 Is there satisfactory evidence that the auditee makes visible potential hazards to the
workers and visitors through signs and warnings?

Finding
Local law: Law on occupational safety and hygiene(Law No. 84/2015/QH13), Article 16. Responsibility
of the employer for assurance of occupational safety and hygiene at the workplace, 6. There are
warning, and instruction signs made in Vietnamese and popular language of employees in relation to
occupational safety and hygiene for machinery,equipment, materials and substances that having strict safety and hygiene requirements at the
workplace, preservation places, usage places that are placed at obvious locations.
FINDING: During the facility tour and management interview, it was noted that operation buttons and emergency stop buttons of 01 out of 04 observed printing machines at printing section were not labeled in local language of employees (Vietnamese).

Question: 7.18 CRUCIAL: Is there satisfactory evidence that the auditee ensures qualified first-aid is
available at all times?

Finding
Local law: Article 6, Circular 19/2016/TT-BYT, the first aid kits shall be placed at working place of workers, be visible, easily accessed and have the Cross mark. The content of the first aid kits shall follow the requirement in the Annex 4 of this circular with 27 required items and type of first aid kits are installed depending on the number of workers in each working section (first aid kit type A for 25 workers, type B for 26 – 50 workers, type C for 51 – 150 workers).
FINDING: During review of first aid procedure and training records, the facility has provided first aid
training for all related employees. The facility also signed contract to local hospital to take care health of employees in emergency case. However, it was noted that 1 out of 6 observed first aid kit in printing section was equipped not sufficiently since there
were only 18 instead of 27 supplies. Note: The number of first aid kit was sufficient as law requirement and it was periodically checked and in good condition.
